One of the roles of the Family Court in Missouri is to put a child support order in place, which orders the non-custodial parent to pay a certain amount of money each month to support a child financially. Whether you are a non-custodial or custodial parent, you need a qualified, experienced attorney to help you with this process.
Child support is calculated using guidelines that consider the gross monthly incomes of both parents and other factors, including:
Other factors include the number of children each party has and the number of overnight stays the child has with the non-custodial parent.
Even though it may seem that the calculations would be straightforward, this is rarely the case. Unfortunately, many child support cases are complex.
Child support orders are typically part of a divorce decree. However, sometimes they are part of a paternity case or another administrative order from the state. Still, at other times, child support orders must be modified when a parent’s financial situation changes.
It’s worth noting that if the father’s name is on the birth certificate, it is presumed that paternity has been established. However, if the father disputes paternity, a judge can order a DNA test before the child support order is confirmed.
Unfortunately, in some cases, a non-custodial parent may refuse to work to avoid paying child support. If you find yourself in this situation, it’s worth noting that the court can impute income or establish an amount a parent should be paying based on their work history, experience, and education and use that amount to determine child support.
The Length of Time a Non-Custodial Parent Is Required to Pay
Generally, child support is paid until the child reaches the age of eighteen. But there are certain exceptions. For example, sometimes child support continues until the child graduates high school, reaches the age of twenty-one, or becomes self-supportive.
It’s important that you have expert guidance to oversee your child support case – to protect your rights and your child’s well-being. Whether you are the custodial parent seeking child support or the non-custodial parent who will likely be required to pay it, we will do everything in our power to ensure that the courts use the best and most accurate information in determining a fair monthly amount.
