No evidence of impairment is needed to be convicted of a DWI charge in Missouri. In fact, a driver 21 and older with a blood alcohol content (BAC) of 0.08% can be charged with a DWI. Drivers 21 and younger can be charged with a DWI for a BAC level as low as 0.02%.
It is important to note that if your BAC is 0.15% or higher, you may be charged with an aggravated DWI.
The penalties for a DWI in Missouri generally depend on the BAC level of the driver as well as the number of prior convictions.
For example, a typical DWI first offense may be considered a Class B misdemeanor, with a minimum jail time between 48 hours and five days and a maximum jail sentence of six months. The person charged may also be fined.
However, multiple convictions result in increased jail time. For example, after four or more DWI convictions, the minimum sentence in Missouri is two years.
Depending on your BAC level, you may also be forced to complete a court-ordered alcohol treatment program.
Of course, a DWI conviction can also result in a license suspension or revocation. If you are convicted of a DWI, the State of Missouri will automatically suspend or revoke your driving privileges for at least 90 days. If this is your first time being charged with a DWI, you may request to install an Ignition Interlock Device in your vehicle -- which will enable you to start your car after blowing into the device. Unfortunately, this privilege is not available to everyone.
Some drivers may receive limited driving privileges after having their license suspended for 30 days.
Neither of these privileges is available for those convicted of a motor vehicle-related felony, leaving the scene of a car accident, or driving under the influence of drugs.
Those who are convicted of a second DWI in Missouri may receive a one-year revocation of their license.
Some drivers refuse to submit to chemical tests for alcohol or drugs if a member of law enforcement pulls them over. This may result in your driving privileges being revoked for one year, which is referred to as “Chemical Revocation.”
